Privacy Policy

1. Introduction and Scope

This Privacy Policy describes how daylyy LLC and its affiliates ("Daylyy," "we," "us," or "our") collect, use, disclose, retain, and protect information about you when you use the Daylyy mobile application, website at https://daylyy.com, and any related products, features, content, functionality, and services (collectively, the "Services").

By using the Services, you acknowledge that we may collect, use, disclose, and process your information as described in this Privacy Policy. If you do not agree, please do not use the Services.

This Privacy Policy applies to information we collect through: the Daylyy mobile application; our website and web-based account or support tools; communications with us, including support requests, emails, texts, and social media interactions; promotional, ambassador, creator, campus, referral, invite, and marketing programs we operate; and any other Daylyy products or services that link to this Privacy Policy.

This Privacy Policy does not apply to third-party websites, applications, services, or content that are not operated or controlled by Daylyy, even if linked from the Services.

2. Information We Collect

2.1 Information You Provide Directly

We may collect information you provide when you create or update an account, complete a profile, upload or create content, participate in promotions or programs, contact support, invite others, connect third-party services, or otherwise submit information. This may include:

  • name or display name, username or handle;

  • email address, phone number, and date of birth or age range;

  • profile photo, school or campus, city, or community information;

  • links to social media profiles;

  • content you create, upload, post, send, or share, including photos, captions, comments, reactions, and other User Content;

  • contact information you provide when using invite or referral features;

  • invite code data, including the code you used to register, when and how it was used, and which user issued it; and

  • communications you send to us.

2.2 Information Collected Automatically

When you use the Services, we may automatically collect:

  • IP address, device identifiers, and mobile advertising identifiers where permitted;

  • app instance identifiers, push notification tokens, and authentication tokens;

  • device model, operating system, browser type, app version, language, carrier, and approximate device settings;

  • crash data, performance logs, diagnostics, and error reports;

  • usage data, including screens viewed, features used, taps, interactions, session duration, referral source, timestamps, and app events;

  • approximate location inferred from IP address or device settings; and

  • precise location information if you grant permission and the feature requires it.

2.3 Information From Device Permissions

Depending on your device settings and how you use the Services, we may request access to: camera (to capture and post content); photos and storage (for profile and account functions); contacts (to help you find or invite people you know, if you choose to use that feature); notifications (for alerts, reminders, account updates, and promotional messages); location (for location-based features); microphone (if audio or video functionality is enabled); and phone or SMS permissions (for account verification and invite flows). Granting a permission does not necessarily mean we collect all available data at all times.

2.4 Information From Other Users and Third Parties

We may receive information about you from other users or third parties, including when another user invites you, tags you, mentions you, or shares your contact information; when you connect a third-party service to the Services; when we receive analytics, fraud-prevention, attribution, or hosting data from service providers; or in connection with legal requests, investigations, or corporate transactions.

3. Public and Social Nature of Daylyy

Daylyy is a social platform. Information you share through the Services may be visible to other users and, depending on the feature, to the public. This may include your username, profile image, profile details, posts, captions, comments, reactions, and location or community context associated with content. Please think carefully before posting — content may be copied, screenshot, reshared, saved, indexed, or discussed by others. We cannot control how other users or third parties use information you make visible through the Services.

4. How We Use Information

We may use the information we collect to:

  • provide, operate, maintain, and improve the Services;

  • create, administer, secure, and verify accounts;

  • enable posting, sharing, account management, invite-only access, and other core functionality;

  • personalize your experience and show relevant content, suggestions, and features;

  • facilitate invites, referrals, community growth, and social discovery;

  • communicate with you about your account, the Services, updates, and security matters;

  • send push notifications, emails, texts, and in-app messages, subject to your choices;

  • analyze usage, performance, growth, and user behavior;

  • troubleshoot, monitor, and improve the security and reliability of the Services;

  • detect, investigate, prevent, or respond to fraud, abuse, spam, harassment, and violations;

  • moderate content and enforce our Terms and policies;

  • develop new products, features, and business operations;

  • administer promotions, creator or ambassador programs, campus programs, contests, and campaigns;

  • use algorithmic, machine learning, and AI-based systems to rank content, detect abuse, personalize experiences, and improve the Services;

  • market, advertise, and promote Daylyy and our business;

  • use public or licensed content in promotional, editorial, publicity, investor, archival, or business materials, as permitted by our Terms of Service; and

  • comply with legal obligations, resolve disputes, and enforce agreements.

5. Promotional and Publicity Use of Content

If your User Content, profile, username, likeness, image, or related information is used by Daylyy pursuant to the content license rights granted in our Terms of Service, we may use that content and associated identifying information for advertising, promotion, publicity, public relations, app store materials, social media content, editorial materials, investor or fundraising materials, and other commercial or business purposes, without additional compensation to you and without further notice beyond the acceptance of our Terms of Service. This is described in detail in Section 7 of our Terms of Service.

6. How We Disclose Information

6.1 With Other Users and the Public

We may disclose information to other users or the public when you choose to share content or make information available through the Services, as described in Section 3 above.

6.2 With Service Providers and Contractors

We may disclose information to vendors, service providers, contractors, and advisors that perform services for us, including hosting and cloud infrastructure, analytics and diagnostics, authentication and account security, customer support and communications, content moderation and trust and safety, marketing and advertising, email, text, and push notification delivery, legal and professional advisory services, and fraud prevention.

6.3 With Affiliates and Business Partners

We may disclose information with our affiliates, subsidiaries, parents, and related companies, and with business partners involved in operating features, promotions, or campaigns.

6.4 For Legal and Safety Reasons

We may disclose information where necessary or appropriate to comply with applicable law, regulation, legal process, or governmental request; enforce our Terms, policies, and rights; detect, investigate, prevent, or address fraud, abuse, safety issues, or security incidents; protect the rights, property, safety, or security of Daylyy, our users, or others; or respond to emergencies or suspected unlawful conduct.

6.5 In a Corporate Transaction

We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, receivership, asset sale, or other corporate transaction. You acknowledge that such transfers may occur and that any acquiring entity may continue to use your information in accordance with this Privacy Policy.

6.6 With Your Consent or at Your Direction

We may disclose information where you direct us to do so or otherwise consent.

We do not sell personal information for monetary consideration. However, certain sharing with advertising and analytics partners may constitute a "sale," "sharing," or targeted advertising under some state privacy laws — see Section 13 for your rights.

7. Location Information and Local Features

If Daylyy offers local, campus, nearby, or location-based features, we may use location-related information, including approximate location from your IP address or device, precise location if you grant permission, school or campus information you provide, and post or activity metadata that may indicate where content was created or viewed. We may use this to show relevant content or communities, improve local discovery features, support moderation and safety efforts, and analyze how local features are used. You can control precise location collection through your device settings. Disabling location access may affect certain features.

8. Contacts, Invites, Referrals, and Invite Code Data

If you use invite, referral, friend-finding, or contact-based features, we may process information you provide, including contact lists, phone numbers, email addresses, and invite code data, to deliver invites, track acceptance, prevent fraud and duplicate accounts, maintain invite activity records, and improve invite and onboarding systems. We also retain invite code metadata — including which code you used to register, when and how it was used, and who issued it — for security, fraud prevention, and auditing purposes. You represent that you have the right to provide any contact information you submit through these features.

9. Cookies, SDKs, and Similar Technologies

We and our service providers use cookies, SDKs, pixels, tags, local storage, device identifiers, APIs, and similar technologies to collect information about your use of the Services. These technologies may be used to keep you signed in, remember preferences, analyze traffic and engagement, measure campaign performance, support security and fraud prevention, and improve the Services. Please review our Cookies, SDKs, and Similar Technologies Policy for more detail. You may control certain cookies through your browser settings and certain mobile identifiers through your device settings.

10. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy. Retention periods may vary depending on the type of information, the reason it was collected, whether it was shared publicly, its sensitivity, and applicable legal requirements. We may retain certain information for legal compliance, investigations, enforcement, fraud prevention, safety, dispute resolution, and moderation purposes even after you delete content or your account. User Content that has been incorporated into promotional or commercial materials may be retained as described in our Terms of Service.

11. Account Deletion and Your Choices

You may be able to access, update, correct, or delete certain account information through the Services. If you request deletion of your account, some information may be deleted immediately while other information may take additional time to remove from active systems and backups. Some information may be retained where legally required or reasonably necessary for legitimate business or safety purposes. Content previously shared with others, incorporated into ongoing campaigns, or retained under rights granted by our Terms may remain available to the extent permitted by law.

If you opt out of promotional emails, we may still send you transactional, security, legal, or service-related communications. You may control push notifications and device permissions through your device settings.

12. Children and Age Restrictions

Daylyy is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without legally sufficient authorization, we may delete that information and suspend or terminate the associated account. We may use age-gating, age verification, or related measures to help enforce age restrictions. If you believe a child under 13 has provided us with their personal information, please contact us immediately.

13. U.S. State Privacy Rights

Depending on where you live, you may have rights under applicable privacy laws, including the right to: know or access certain personal information we collect about you; correct certain inaccurate personal information; request deletion of certain personal information; obtain a portable copy of certain personal information; opt out of certain processing for targeted advertising, profiling, or certain disclosures; and appeal a denial of certain privacy rights requests. We will not unlawfully discriminate against you for exercising applicable privacy rights.

California residents have additional rights under the CCPA as amended by the CPRA. These include the right to know, delete, correct, limit use of sensitive personal information, and opt out of the sale or sharing of personal information. To submit a California privacy request, contact us with "California Privacy Request" in the subject line.

We honor applicable rights under privacy laws in effect in California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia, and other states as new laws take effect.

We do not currently respond to browser Do Not Track signals. Where required by applicable law, we honor Global Privacy Control (GPC) opt-out signals.

14. California Privacy Notice — Categories Collected

In the past twelve months, we may have collected the following categories of personal information: identifiers; customer records information; internet or network activity information; geolocation information; audio, electronic, visual, or similar information; profile or account information; commercial or transaction information where applicable; and inferences drawn from activity or usage. We collect these categories from the sources described in Section 2 and use and disclose them for the purposes described in this Privacy Policy.

15. International Users

Daylyy is based in the United States and may process and store information in the United States and other countries where we or our service providers operate. Those countries may have data protection laws that differ from the laws in your jurisdiction. By using the Services, you understand that your information may be transferred to and processed in the United States and other jurisdictions, subject to applicable legal requirements.

Where applicable law requires a legal basis for processing, we rely on performance of a contract, our legitimate interests in operating and improving the Services, compliance with legal obligations, and your consent where required. Where processing is based on consent, you may withdraw consent as permitted by applicable law, but withdrawal will not affect prior processing.

16. Security

We use commercially reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, and disclosure. However, no system or transmission method is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for securing the devices you use to access the Services. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you and applicable regulatory authorities as required by law.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make changes, we will post the updated version and revise the "Last Updated" date above. If required by law, we will provide additional notice or obtain consent. Your continued use of the Services after the updated Privacy Policy becomes effective constitutes your acknowledgment of the updated Privacy Policy.
